Release of Liability Agreement
This Release of Liability Agreement identifies the parties involved and the inherent risks associated with saltwater fishing and boating adventures in Baja California Sur. Participant acknowledges that fishing activities involve physical exertion and exposure to the marine environment.
By signing this document, I voluntarily assume all risks, known or unknown, which might occur as a result of participation in guided fishing trips. I hereby release, waive, and discharge Baja Fish Guide and its representatives from any and all liability, claims, or demands arising out of my participation in these activities.
Safety & Participant Acknowledgement
Engaging in our guided fishing adventures necessitates adequate physical stamina and the ability to maneuver across beaches and onto boats. For your protection, life jackets and all necessary safety gear must be worn by participants at any time the guide provides instructions to do so during the excursion.
Guests are expected to comply with every directive from the guide concerning equipment usage, secure casting perimeters, and habitat conservation. It is mandatory for participants to communicate any known medical issues or specific allergies before we launch.
Baja Fish Guide retains full authority to adjust or cancel itineraries if oceanic or weather conditions are deemed hazardous by our experts or harbor officials.
Terms and Conditions
1. Property Damage and Equipment: Participants are responsible for the proper care of all equipment provided by Baja Fish Guide. In the event of damage resulting from negligence or failure to follow guide instructions, the participant agrees to cover the costs of repair or replacement. This includes, but is not limited to, fishing rods, reels, panga boat equipment, and property at Casa Marino.
2. Personal Injury and Medical Risks: Engaging in guided fishing excursions involves inherent risks. Baja Fish Guide is not liable for personal injuries, illnesses, or accidents occurring during the trip. Participants must disclose any pre-existing medical conditions that may affect their ability to safely participate in shore or boat-based angling activities.
3. Unforeseen Weather Events: Baja Fish Guide reserves the right to cancel or modify excursions due to unsafe weather conditions, including high winds or dangerous surf. In such cases, we follow our Cancellation Policy. We are not responsible for additional expenses incurred by participants due to these unforeseen environmental factors, such as travel or external lodging costs.
4. Local Laws and Compliance: All participants must adhere to Mexican federal fishing regulations and marine park rules within Cabo Pulmo. Failure to comply with legal requirements or guide safety directions may result in immediate termination of the excursion without refund.
Liability Waiver & Consent
Each participant must complete and submit this Liability Waiver & Consent form before taking part in any guided fishing activities.
